Jason Smith Not Fined by NFL After Ejection for Pushing Official

It seems that the NFL agreed with 49ers defensive end Justin Smith that there was no premeditation or malice in Smith's shove of umpire Garth DeFelice a week ago Thursday in a loss to San Diego.

The league could have fined Smith, which is what has happened to most other players charged with making contact with an official. The league chose not to, which seems to dispute the in-game decision of referee Clete Blakeman that the contact was "intentional.''

Smith, who was ejected from the game, will be able to play Sunday in the 49ers' must-win game against the Rams in St. Louis.
